Terms of Service: Nexigon’s Demo Instance

Silitics GmbH (“We”, “Us”, or “Our”) offers access to a demo instance of Nexigon at https://demo.nexigon.dev (the “Demo Instance”) to allow potential customers to explore and assess Nexigon’s functionality. By creating an account on the Demo Instance, you agree to the terms and conditions set forth in this agreement.

We may change these Terms of Service at any time. It is your responsibility to periodically review this page for changes. Your continued use of the Demo Instance constitutes your acceptance of such changes.

Note: Use of the Demo Instance for ongoing operational or business-critical purposes is generally not considered within the scope of the Allowed Purposes as defined below.

1. Allowed Purposes

1.1 The Demo Instance is provided solely for demonstration and evaluation purposes (the Allowed Purposes). Allowed Purposes are purposes that target the evaluation of Nexigon’s functionality, performance, and features with the goal to provide feedback to Us or make a decision on whether to purchase Nexigon.

1.2 By signing up, you agree that we may contact you to gather feedback or discuss your evaluation experience.

1.3 You agree to not reverse-engineer Nexigon or any other software or technology provided by Us.

1.4 You may test and probe the Demo Instance for evaluating its security provided that:

      1.4.1 you take all reasonable precautions to protect the integrity and confidentiality of any data,

      1.4.2 you disclose any findings to Us without undue delay, and

      1.4.3 you do not disclose any findings to any third party without giving us time to address any issues.

1.5 All intellectual property rights in and to Nexigon and the Demo Instance, including underlying software, code, and designs, are and remain the exclusive property of Silitics GmbH or its licensors. No rights are granted beyond those necessary for the Allowed Purposes.

2. No Fees, No Guarantees

2.1 The Demo Instance is provided free of charge and as-is.

2.2 The Demo Instance is provided without any warranties of any kind whatsoever, whether express or implied, including without limitation warranties of availability, functionality, or performance.

2.3 We may modify, restrict, suspend, or discontinue the Demo Instance at any time and without prior notice.

2.4 You have no entitlement to continued access, uptime, or support.

3. Liability Limitations

3.1 We shall not be liable for any damages or losses arising out of or in connection with your use of the Demo Instance, unless such damages or losses are caused by gross negligence or willful misconduct.

3.2 The limitation as per Clause 3.1 does not apply in cases of injury to a person’s life, body, or health, or in cases of mandatory product liability under German law.

4. Indemnities

4.1 You agree to indemnify and hold us harmless from any and all liabilities, claims, and expenses arising out of or in connection with a breach of these Terms of Service by you.

5. Data Processing

5.1 During signup, we collect personal data necessary to manage access and follow up on the evaluation. The handling of your personal data is governed by our Privacy Policy.

5.2 The Demo Instance is not designed for storing or processing sensitive, confidential, or legally protected data. We do not guarantee confidentiality, availability, or integrity of any data you enter.

6. Termination

6.1 We may terminate this agreement at any time, for any reason, without notice, and at our sole discretion.

6.2 Upon termination, you will no longer have access to the Demo Instance and all associated data.

6.3 You may delete your account at any time through Nexigon’s UI or by contacting us at hello@nexigon.dev.

7. General

7.1 These terms are governed and shall be construed exclusively by the laws of Germany without giving effect to its conflict of law provisions.

7.2 The UN Convention on Contracts for the International Sale of Goods (CISG) shall not apply.

7.3 If you are a merchant (§ 14 BGB), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising out of or in connection with these terms shall be with the competent courts of Frankfurt am Main, Germany.
